Facts about Tinker V. Des Moines
- In December 1965 a group of students attending Des Moines college gathered to plan how they would show support for the truce in the Vietnam war. They decided to wear black armband s through the holiday season.
- The principals of Des Moines learned of this gathering and met December 14. They then created a policy stating " any student wearing an armband would be asked to remove it,"
- On December 16, Mary Beth Tinker & Christopher Eckhardt wore armbands to school and were sent home. The next day, John Tinker did the same thing and was also sent home.The students weren't allowed to come back until after holiday break.
- "Through their parents, the students sued the school district for violating the students' right of expression and sought an injunction to prevent the school district from disciplining the students."
- "The district court dismissed the case and held that the school district's actions were reasonable to uphold school discipline. The U.S. Court of Appeals for the Eighth Circuit affirmed the decision without opinion."
